PZC Packet 010588. -s STAFF REPORT TO THE PLANNING AND ZONING COMMISSION - 1/5/38 WAL-MART COMMUNITY SHOPPING CENTER LOTS 23/75, BLOCK 2, Benchmark at Beaver Creek Trash Compactor and Building Modification Design Review INTRODUCTION: Wal-Mart Stores has requested approval of two minor changes they propose for their project which is under construction. The original design review approval for the Wal-Mart building included a curved metal frame, with neon lighting, to be placed on the roof above the main entry and in the back of the building. The building owner requested that this feature be deleted from the construction plans and would like Commission approval of this change. In addition to this, they are requesting approval for a screening fence for their trash compactor which is located on the south side of the building. The proposed fence is approximately six (6) feet high, chain link, with vinyl inserts. STAFF COMMENTS: The curved metal frames being deleted have little effect on the appearance of the project. The trash compactor proposed is approximately five (5) feet high and appears to fit well within the proposed enclosure. If approved, the Commission should consider what color the vinyl inserts should be to best screen the compactor. RECOMMENDED ACTION: 1. Introduce project; 2. Presentation by Applicant; 3. The antenna is a part of Wal -Mart's corporate communication syst-:m. This is an item that was not addressed in previous design review approvals. The proposed dish is approximately six (6) feet in diameter, mounted approximately two (2) feet above the roof of the building. STAFF COMMENTS: The Planning and Zoning Commission Rules and Regulations provide for the installation of satellite dish antennas. Those guidelines, along with responses from staff concerning this application, are listed below. 1. All antennas shall be located so as to be screened from view from any public right-of-way or neighboring property. Screening may be accomplished by incorporating the antenna into building design, or through the use of landscaping mc.terials, fencing, existing structures, subgrade placements, or other means that both screen the antenna and appear natural to the site; Response: Applicant proposes to place the sattelite dish on the roof of the Wal-Mart building. This location offers virtually no screening for the dish, which has a six (6) foot diameter. 2. All wiring and cable related to antenna installation shall be installed underground or be incorporated entirely within the structure; Response: In it's current location, all wiring will go down through the rocf and into the building. The use of mesh antennas is encouraged. Response: The information submitted shows a solid metal dish, approximately six (6) feet in diameter. 4. Color selection for dish antennas should be made with respect to the characteristics of the site or structure. Unpainted surfaces and dish antennas with reflective surfaces shall not be allowed. No advertising, logos, or identification shall be allowed on any dish antenna. Response: (No details have been provided on dish color.) STAFF RECOMMENDATION: Staff feels that this application does not conform with the guidelines for satellite dish antennas outlined in the Planning & Zoning Commission Rules and Regulations. Staff recommends that the Commission direct the applicant to explore other locations for the dish that would better conform with the guidelines, i.e., placement on the y ound on the south side of the building. If the Commission must deny the application, staff recommends that action be deferred until staff can prepare a resolution for adoption by the Commission outlining the reasons for such denial. They are proposing changing the two building mounted signs to reflect the new name of the bank, as well as adding a monument sign with the company name and a time -temperature readout feature. STAFF COMMENTS: A review of this proposal shows the following sign areas being requested: Building mounted sign at 50 square feet feet Building mounted sign at 36 ft./side 36 72 square square feet Monument Total sign at sq. Sign Area Requested 158 square feet Total Sign Allowance per Code 96 square feet Excess Sijn Area Requested 62 square feet The building currently has approximately 110 square feet of signage divided between two signs. The proposal for replacing the building mounted signs appears to fall within the 96 square foot sign allowance for individual business lot signage. A variance will be required for approximately 62 square feet for the monument sign. The applicant is also requesting permission to place banners over the existing signage, showing the new name, until such time as the new signs are placed. They would like to place two banners, approximately 75 square feet each for a total of 150 square feet, from January 5, 1988 until April 1, 1988. Since the Sign Code allows only one banner no larger than 16 square feet to be permitted for one week of each one hundred and twenty day period, a variance will also be required for this. Before acting on a variance request, the Planning and Zoning Commission shall consider the following factors: a. The relationship of the requested variance to existing and potential uses and structures in the vicinity; b. The strict or literal interpretation and enforcement of the regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title, ii. There are exceptional or extraordinary circumstances or conditions applicable to the site of the variance that do not apply generally to other properties in the vicinity. iii. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the vicinity. STAFF RECOMMENDATIONS: If the Commission approves the sign program as submitted, Staff recommends that the Applciant work with Staff on the location of the monument sign to avoid any problems with required setbacks for this sign.
