I. Call to Order
The meeting was called to order at 6:00 pm.
11. Roll Call
All Commissioners were present with the exception of Commissioner Chris
Evans and Commissioner Andrew Karow.
III. Additions and Amendments to the Agenda --
There are two amendments to the Agenda. A revised landscaping plan and oaint
samples which this Commission has already reviewed for Lot 45C, Block 2,
Wildridge Subdivision, 2520 Old Trail, for final design approval to the Consent
Agenda and Item VIII, A, Sign Design, Barrancas Address Signs, Lots 40/41,
Block 1, Benchmark at Beaver Creek Subdivision, 491/51 1 Metcalf Road, to the
Consent Agenda.
IV. Conflicts of Interest
There were no conflicts of interest.
V. Consent Agenda
Commissioner Trueblood motioned for the approval of the Meeting Minutes from
the August 5, 2003, Planning & Zoning Commission Meeting and to approve Lot
45C, Block 2, Wildridge Subdivision, for final design approval to the Consent
Agenda and Barrancas Address Signs, Lots 40/41, Block 1, Benchmark at
Beaver Creek Subdivision, 491/511 Metcalf Road, to the Consent Agenda the Lot
7, Block 1, Wildridge Subdivision Final Design. Commissioner Didier seconded
the motion. The motion passed unanimously.

Accessory Structure Design
Applicants/Owners: Patty McKenny
Matt Pielsticker presented the Staff Report. In May of 2003, staff approved a
Minor Project on the McKenny house. Most of the work has been completed and
normally this is not brought up to the Planning and Zoning Commission but
complaints have warranted Commission review and approval. Patrick McKenny,
applicant, approached the podium to discuss his intentions of the children's
playground. Planning and Zoning did a site tour of this property. The Building
Department has stated this playground is not a structure and they have no
issues. John Quinn, neighbor with complaints, approached the podium. He
opposed the structure for its overly large size; voiced that the elevation was not
in keeping with Design Guidelines. Catherine Zukoya, Quinn's partner,
approached the podium in defense of Mr. Quinn and voiced her disapproval of
the playground. Mr. McKenny does not want it to be an inconvenience to his
neighbors. Commissioner Didier asked why the structure was placed so high up
on the property. The flatter area of the property is reserved for running around
by the children, and it made sense to place the playground here considering how
steep the rest of the yard is.
Commissioner Trueblood recommended approval of the project with
Commissioner Him seconding the motion. Motion passed with a three to two
vote. Commissioner Didier and Commissioner Smith denied approval.
B. Lot 49A, Block 4, Wildridge Subdivision

Landscaping Improvements
Applicant: Barbara Bright
Ruth Borne presented for staff. Approval for landscaping was given by comm.
Dev. Extra trees were planted and the neighbor, Lynne Young of Lot 49B, felt
the trees are on her property. Barbara Bright, lot 49a, approached the podium.
Ms. Bright represents the owners of lot 49a. She voiced her desire to work with
her neighbor.

VII. Special Review Use Applications:
A. Fiasco Restaurant/Tavern
Lot 13, Block 1, Benchmark at Beaver Creek Subdivision

Applicant/Owner: David Svabik
Matt Pielsticker presented the staff's recommendations on this project.
Compatibility of this project on this site was discussed. Staff recommended
denial. Dave Svabik presented his perception of the project. Terrell Knight,
private planner for Mr. Svabik, voiced his opinions. Denial has previously
occurred. In previous meetings, his constituents declared their desire for this
project to occur. Parking was an issue previously and has been resolved with
the reduction of seating and the ability to add additional spaces. Drainage and
grading issues were discussed with positive solutions. Mr. Knight brought to light
the timing of its intensity of use as mid -day and evening, which is different from
the normal day use. Town of Avon's Master Plan allows for changes in
neighborhoods and additional landscaping would be installed. There are no trails
in this area so it is not an issue. Pedestrian trails would be built and issues such
as lighting would be addressed. He feels it is a benefit to the neighborhood and
would not be detrimental for the town. Kathryn Johnson, Mrs. Svabik,
approached the podium in support of the project.
Commissioner Trueblood questioned the decrease in parking spaces to 30 from
65. There was a decrease in the size of seating area within the structure.
Outdoor seating does not affect the parking spaces requirement. And, he
questioned the issues of development of this project and would resale put
irresponsible tenants in control. Commissioner Neville brought up the issues of
the lack of public transportation to the location.
Commissioner Neville motioned for denial and Commissioner Hirn seconded.
This motion passed with a 4 to 1 vote with Commissioner Didier approving.
B. Calvary Chapel Vail Valley

Tambi Katieb presented the staffs report. Staff recommends approval with the
three conditions from the report. Mike McClinton, representing the applicant,
approached the podium. Larry Dunworth, Avon Self Storage, stated what great
neighbors the applicant has been.
Commissioner Him motioned to approve the Special Review Use with the four
conditions as stated in the staff report. Commissioner Neville seconded the
motion and motion passed unanimously.

Lot 40, Block 1, Benchmark at Beaver Creek Subdivision (Barrancas)
Fieldstone Development has submitted a revised landscaping plan for the Barrancas Phase I
project at the above -mentioned lot. Due to modifications to the original Site Plan, changes have
been made to the originally approved landscaping plan. The quantity and type of plants and
trees being proposed is comparable to the original plan. The placement of trees is the. only
variation between the original approval and this plan. Large copies of the original and the
revised landscaping plan will be available to review at the September 2, 2003 Site Tour and
Work Session.
Staff Recommendations: Staff recommends approval of the revised landscaping design
plan for Lot 40, Block 1, Benchmark at Beaver Creek Subdivision with the following
condition(s):
1. All landscaping and irrigation must be installed and inspected by Community
Development no later than October 30, 2003. This includes revegetation of all
disturbed slopes.
2. No trees may be planted within the Metcalf Road Right of Way.
3. Remove Cottonwoods from the Plan and replace with another evergreen tree equal
in number.
4. Incorporate several large boulders into landscape island between buildings C and D
to provide an additional barrier to vehicles.
5. Except as otherwise modified by this permit approval, all material representations
made by the applicant or applicant representative(s) in this application and in public
hearing(s) shall be adhered to and considered binding conditions of approval.

Introduction
The Master Sign Program (MSP) for the Petro -Hut building was approved on May 20, 2003.
The applicant, Talbot Intermountain Insurance, is requesting a MSP Amendment to change the
color of the three south facing tenant signs. This application proposes a teal color to replace the
already approved forest green for tenant sign lettering MSP. Community Develop)nent has
received a letter of approval from the property manager approving the new sign color. No other
changes to the MSP are proposed with this application. Staff recommends denial of this
application.
Design Review Considerations
According to the Town of Avon Sign, Section 15.28.070, the Planning & Zoning
Commission shall consider the following items in reviewing proposed designs:
1. The suitability of the improvement, including materials with which the sign is to be
constructed and the site upon it is to be located.
The location and materials of the proposed signage are consistent with the existing MSP.
2. The nature of adjacent and neighboring improvements.
This amendment would require the two other tenants with identical sign allowances to use
the same teal color instead of the existing forest green.
3. The quality of the materials to be utilized in any proposed improvement.
The quality of the materials to be utilized does not change.
4. The visual impact of any proposed improvement, as viewed from any adjacent or
neighboring property.
It is staff s opinion that the proposed signage may adversely impact the neighboring
properties. The Commercial Design Guidelines encourages colors that are harmonious with

6. Whether the type, height, size, and/or quality of signs generally complies with the sign
code, and are appropriate for the project.
The Commission already approved the type, quality, and size of the tenant signs. Staff feels
that the materials and size of the signs are appropriate; however, the color is not acceptable.
7. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whetherthesignisappropriateforthedeterminedorientation
The four signs are oriented to vehicular traffic. This orientation is appropriate.
Staff Recommendation
Staff recommends denial of the Master Sign Program Amendment for Lots 67/68, Block 1,
Benchmark at Beaver Creek Subdivision do to the following finding:
1. The proposed amendment does not utilize a natural or earth tone color.

3. Upper Floor Tenant Signs
a.) Building mounted base substrate of '/" thick aluminum to shape (see
attachment) primed and painted with polyurethane mounted to building by Hilti
stucco anchoring system and mechanical hardware. The base plate will have
extruding permanently mounted '/4" threaded studs for attaching tenant panels with
hex head cap nuts. This "base plate" will be considered a fixed asset and is to
remain property of the building once installed. Base plate shall match PMS color
554 Forest Green.
Ammend to Matte Black
Tenant panel will stud mount extruding from base plate with '/2" standoffs. Tenant
panel shall be fabricated of V aluminum or dibond primed and painted with
polyurethane to match building beige, Forest Green, and Duronodic Bronze
colors. (see attached art files)
Ammend to: match building trim creme, with Teal borders and trim PMS #321C
Text portion of sign may consist of a business name, nature of the business and
logo if applicable. Text may be of a font determined by tenant_ The business name
shall be raised text; minimum 5/8" thick mounted flush to tenant panel. Nature of the
business text may be made of dimensional painted aluminum letters or flush vinyl
letters. All text shall match building trim paint spec or vinyl Avery high
performance opaque beige.
Ammened to: Text to match teal border PMS #321 C
Note: This amendment is directed at upper floor tenant panel color changes
only. All other criteria, sizing, materials, lighting along with the sign program
requiring upper floor tenants to remain in this ammended color scheme
remain intact and unchanged.
