NOTES ON AMENDMENT #9, 1981
Re Section 4.3(b)
Applicant should send notification to adjacent land owners by first class
mail. See Ordinance No. 79-1�, Section 3.4, Rules of Procedure for Special
Review Approval.
Re (f), Fees - Terms (page
We would like it to read: variance fee shall be paid at the time of the
application. Base fee should be $100.00, plus any additional fee for con-
sultant.
Re (h) Council Recess (page 3)
The Design Review Board wants the ability to table, continue, or recess an
application for additional information.
Other Points:
* We recommend the Council not necessarily review approvals of the Design
Review Board.
* The decision of the Design Review Board should be final.
* Any affected person my appeal the decision to the Council.
* An appeal process may be incorporated in this Ordinance.
* The Design Review Board shall state reasons for their final action, and
may impose conditions for approval.
Items to be Discussed Further:
No variance considered to change permitted use in any zone district; on
height of building; or density change.
Discrepancies between the Design Review Board Procedures, Rules and Regulations
and the Zoning Code, such as:
Rules on trailers, tents and temporary sheds.
Rules on loading spaces and parking spaces.

The work session was continued to April 29, 1981 at 7 P. M. at the Benchmark
offices.
Those present were Mike Blair, Ken Hardwick, Larry Kumpost, Alice Alpi, Tom
Landauer and Dick Evans. Bill Pierce and Cheryl Dingwell were absent.
DESIGN REVIEW BOARD
WORK SESSION, APRIL 29, 1981
The Continued work session was held at the Benchmark Offices at 7:00 P.M.
April 29, 1981. Those attending were Cheryl Dingwell, Bill Pierce, Alice Alpi,
Ken Hardwick, Mike Blair, Torn Landauer and Dick Evans. Larry Kumpost was ab-
sent.
After much discussion the Members recommended that the Ordinance No. 9,
Series of 1981, be reworded as follows:
Section 4.3,b,1
(1) Application for a variance shall be made to the Design Review Board.
The Design Review Board, within 30 days of receipt of the application,
shall hold a public hearing on the application.
(2) As a part of the review and recommendation process by the Design
Review Board, the Town, for any variance, shall post the property
with a sign notifying the general public of the time and place of
a meeting before the Board at which said property shall be reviewed
for a variance. (NOTE: the remainder of the paragraph remains as is)
(3) Notice of such hearing shall be published in a newspaper of general
circulation within the Town or posted in at least three public places
within the Town, in addition to posting at the office of the Town
Clerk, at least fifteen days prior to the hearing date.
(Here we would add:)
(4) The applicant will submit an affadavit seven (7) days prior to the
hearing that he has sent out riot -ices to affected land owners.
(We recommend a return receipt made out to the applicant. The applicant
must present evidence of the receipts.)
Results of discussion on Design Review Board Procedures, Rules and Regulations
as to how they could be reviewed, rewritten, etc.:
