Introduction
The applicant, Calf-A-Coffee, in conjunction with City Market is requesting an 8’ x 8’ kiosk on the City Market parking lot. The applicant is proposing two-way coffee service for this
business. The kiosk is designed to match the existing colors and materials of City Market.
Staff recommended the applicant move the kiosk further back on the site so that the 7-car cueing requirement could be met. The applicant has resisted this proposal and has submitted
a letter from John L. Caldwell, Director of City Market Real Estate. A copy of the letter is attached hereto for your review.
Staff is concerned with the overall impact of traffic with this proposal. Currently, City Market has traffic congestion during peak hours. The proposed site for the kiosk does not
allow for 7-car cueing, which conflicts with the Town of Avon Standards.
The parking requirements for City Market are as follows:
Commercial area: 216 parking spaces
Residential/employee housing: 28 parking spaces (2 spaces per unit required)
**Does not include any parking credit granted for employee housing
Total required parking spaces: 244 parking spaces
Existing parking: 229 parking spaces
The Calf-a-Coffee proposal will delete a minimum of 7 parking spaces to accommodate a two-way kiosk. The parking is currently under the Town of Avon requirements and will unduly burden
an already congested parking lot. Furthermore, the proposal does not provide for adequate cueing. Therefore, staff cannot recommend approval.
Design Review Considerations
As a result of the applicant failing to comply with the fundamental code requirements for parking and cueing, staff has not analyzed the design criteria. As mentioned herein, the materials
and colors will match the existing City Market.
Recommended Motion
I recommend denying the application for the Calf-A-Coffee kiosk. The project does not comply with existing parking and cueing requirements for the site.

Approved Motion
Commissioner Fehlner moved to approve the drive-thru coffee kiosk on Lot 67 and 68, Benchmark at Beaver Creek Subdivision, as depicted on the application and plan set dated October 25,
1999 with the following conditions:
The kiosk must be placed 25’0” from the property line;
A sign application for the project will be submitted for staff approval;
The hours of coffee service are limited to 6 a.m.-3 p.m. for forty-five (45) days to determine the traffic impacts posed by this drive-thru. After forty-five (45) days, the applicant
can request relief from this condition.
The approval is good for one year, unless staff determines there are no adverse impacts posed by this project.
Commissioner Sipes seconded. The motion passes 5-2 with Commissioner Evans and Commissioner Morrison opposing.
