L11 B1 BMBC SRU apartmentsTown of Avon Special Review Use Staff Report September 21, 1999 Planning & Zoning Commission meeting Report date December 20, 2019  Special Review Use type Employee housing units  Legal description Lot 11, Block 1, Benchmark at Beaver Creek Subdivision  Zoning IC - Industrial and Commercial  Address 451 Metcalf Road  Introduction In April 1997, the Planning and Zoning Commission granted approval of a Special Review Use and Final Design Plans for a second building at Avon Auto Body with several conditions. The building was approved for auto body repair with offices on the third floor. Louis Mederios, is now requesting a special use permit for two employee housing units on the third floor instead of the offices. No other changes are proposed at this time. The property is Zoned IC, for industrial-commercial development. The Zoning Code allows up to four accessory residential units for each lot in this zone. Criteria for Review, Recommendation and Approval According to Section 17.48.040 of the Avon Municipal Code, the Planning & Zoning Commission shall consider the following criteria when evaluating an application for a special review use permit: Whether the proposed use otherwise complies with all requirements imposed by the zoning code. There are no changes to the approved plans other then converting the offices to two apartments. It is staff’s opinion that no additional parking spaces are required since the apartments are for employees who would already be parking on the site. Whether the proposed use is in conformance with the town comprehensive plan. The Comprehensive Plan designates this area for industrial land uses. The accessory employee housing units are not in conflict with the Comprehensive Plan. Whether the proposed use is compatible with adjacent uses. Such compatibility may be expressed in appearance, architectural scale and features, site design, and odor, lighting, traffic, safety, etc. The two proposed residences would not pose a conflict with surrounding industrial uses. Having people on the premises 24 hours a day creates additional security. The industrial uses should not present conflicts for the employee housing provided that the on-site auto body or other activities do not occur late into the night when the employees would be sleeping. Design Review Criteria No changes to the exterior of the site are proposed, therefore no design review is required. Staff Recommendation Staff recommends approval of the Special Review to allow two employee apartments at Lot 11, Block 1, Benchmark at Beaver Creek Subdivision as described on the application and site plans dated 9-1-99 with conditions. Staff has included all of the conditions from the original approval that are still pertinent. Recommended Motion “I move to approve the Special Review Use for two employee apartments at Lot 11, Block 1, Benchmark at Beaver Creek Subdivision as described on the application and site plans dated 9-1-99 with the following conditions: The six foot block fence matching the building must be erected during phase I of the site construction. No snow accumulation shall occur outside designated snow storage areas. Any excess snow shall be hauled off-site. The applicant shall provide a lighting cut sheet for the 12-foot parking lot standards for Commission approval. The applicant shall finish the walls to match the proposed building. Upgrade lighting on existing building to eliminate off-site glare. Repaint existing roof vents to match roof. Paint existing building to match new building. Add landscaping to the northeast corner to provide screening. Eliminate Soffit lighting. Retaining Walls in the setbacks shall be four feet or less.
