Introduction
This single-family residence received final design approval on August 8, 1997. The approved site plan indicated that the limits of disturbance would extend to approximately 10 feet below
the structure, with minimal grading. The majority of the excavation material was to be exported from the site.
During the project’s construction, however, all excavation material was deposited on the hillside below the building. This increased the area of site disturbance by approximately 140%
and raised the grade level by nearly six feet. The applicant is now applying for approval of this site plan modification.
Design Review Considerations
According to the Commission’s Procedures, Rules & Regulations, Section 6.10, the Commission shall consider the following items in reviewing the design of this project:
Conformance with the Zoning Code and other applicable regulations of the Town.
Grading: All proposed slope grades conform with the maximum of 2:1 slope guideline.
Landscaping: The increased area of disturbance should not only be stabilized, but the visual impacts to the hillside should be mitigated through the replacement of sufficient indigenous
vegetation, such as sage and serviceberry bushes.
The suitability of the improvement, including type and quality of materials of which it is to be constructed and the site upon which it is to be located.
The compatibility of the design to minimize site impacts to adjacent properties.
The compatibility of the proposed improvements with site topography.
The proposed modification is an unnatural manipulation of the site topography.
The visual appearance of any proposed improvement as viewed from adjacent and neighboring properties and public ways.
The proposed modification has more than doubled the area of site disturbance, leaving a signature visible throughout the subdivision. Though the material has been graded to blend as
with the site’s slope, the nearly 6-foot depth of fill creates an unnatural deviation from the natural grade.
The objective that no improvement be so similar or dissimilar to others in the vicinity that values, monetary or aesthetic will be impaired.
While there are examples of past projects within the subdivision that created similar impacts, staff believes these projects are contrary to the Town’s design guidelines and should not
be repeated.
The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon.
Staff believes that the proposed site modification fails to conform with the goals, policies and programs for the Town of Avon. Specifically, this modification directly conflicts with
the Steep Slope Development Guidelines' strong recommendation to preserve the existing terrain and native plant materials.
Staff Recommendation
Staff recommends denial of the proposed site modification based upon its incompatibility with site topography and its visual impact upon the hillside as viewed from neighboring properties.
Further, staff recommends that the fill material be removed from the site to conform with the approved site plan, and that the areas of disturbance be stabilized and re-vegated with
indigenous grasses, sage and serviceberry plant materials.
Recommended Motion
“I move to deny the modification of the approved site plan for Lot 46, Block 3, Wildridge Subdivision, as depicted on the application and site plan dated March 18, 1998, based upon the
modifications failure to comply with design review considerations 1, 4, 5, 6, & 7.”
