Introduction
Mr. Borg has submitted a new application for a Special Review Use Permit to operate a two guestroom residential Bed and Breakfast (B & B). The Commission recently denied Mr. Borg’s earlier
application for a three guestroom B & B based upon the finding that the proposed use was not compatible with adjacent uses in terms of available parking (Criteria #3).
Criteria for Review, Recommendation and Approval
According to section 17.48.040 of the Avon Municipal Code, the Planning & Zoning Commission shall consider the following criteria when evaluating an application for a special review
use permit:
Whether the proposed use otherwise complies with all requirements imposed by the zoning code.
The proposed B & B complies with all requirements of the zoning code. The RD Zoning District allows for consideration of B & B’s as a SRU, the B & B would be located in an owner-occupied
dwelling unit and would operate one less than the allowed maximum of three guestrooms.
Whether the proposed use is in conformance with the town comprehensive plan.
The proposed B & B conforms most directly with the Town of Avon Comprehensive Plan by creating a facility that strengthens both the Town’s year-round tourism base and relationship to
the resort community (Policy B3.1).
Whether the proposed use is compatible with adjacent uses.
Staff recommends that a B & B provide one parking space per guestroom, as it can be reasonably anticipated that each guestroom will create the need for a parking space.
Unit B has four parking spaces. With the conversion of the two bedrooms and a recreation room from residential use to a B & B use, Unit B’s residential parking requirement becomes
two spaces. Unit B’s two remaining parking spaces can then be allocated to the B & B use, thus satisfying the recommendation for one space per B & B guestroom.
Staff Recommendation
Based upon the proposed B & B’s compliance with the above criteria, staff recommends approval of the Special Review Use Permit.

“I move to approve Resolution # 97-16, granting a Special Review Use Permit for Lot 38B, Block 2, Benchmark at Beaver Creek Subdivision, to operate a two guestroom Residential Bed and
Breakfast as described in the application dated November 20, 1997, for a permanent duration as specified in Section 17.48.020 of the Town of Avon Municipal Code.”
