DEVELOPMENT CODE NOTICE REQUIREMENTS
This Formal Finding is made in accordance with Avon Development Code, Section 7.16.020(d)(4)
FINDINGS OF FACT: Traer Creek -RP LLC submitted a PUD Amendment application for Planning
Area F, Village (at Avon). There was an original mailed notice sent on October 6, 2017 and an initial
public hearing held by the Avon Planning and Zoning Commission ("PZC") on October 17, 2017. After
two continuations of the public hearing, the Avon PZC "Tabled" the application December 5, 2017. A
new mailed notice was sent on December 22, 2017 for a public hearing to be held on January 2, 2017.
The Avon PZC public hearing was continued to January 16, 2018, then continued to February 6, 2018,
then continued to February 20, 2018, then continued to March 6, 2018, at which meeting the Avon PZC
took action to make a recommendation on the application. The Avon PZC motions to continue were to
the Planning and Zoning Commission meeting on a specified date. The Avon Planning and Zoning
Commission meets at the same time and same place for its regular meetings, therefore the meeting start
time of 5:00 p.m. and location at the Avon Town Hall are common knowledge.
Ms. Tamra Underwood submitted public comments on March 27, 2018 alleging a violation of due
process and previously submitted an e-mail on January 16, 2018, expressly concerns about the public
hearing before the Avon Planning Commission scheduled for January 16, 2018. Ms. Underwood's e-mail
comments on January 16, 2018 state that she did not receive a mailed notice.
The applicant provided a Public Notice in the form required by and acceptable to the Town along
with a Planning Area F mailing list and a "Lot I Courtesy Mailing List" which included the address
Tamra N. Underwood, P.O. Box 953, Avon, CO 81620-0953. Ms. Underwood's January 16, 2018 e-mail
comment acknowledged awareness of the January 16, 2018 public hearing.
FORMAL FINDING: The records of the Town document the mailing of the notice as required by
Section 7.16.020(d); therefore, it is presumed that notice was given as required by Section 7.16.020(d).
The Avon PZC, as the reviewing body, took action at each regular meeting from January 2, 2018 through
February 20, 2018 to continue the public hearing to a future specified date, time and location, and
therefore constructive notice is deemed to have been provided for such continued hearing date and
additional notices were not required in accordance with Section 7.16.020(d)(4).
THEREFORE, based on the evidence and findings of fact, the Avon Town Council formally finds on
April 10, 2018, that there was substantial compliance with the notice requirements of the Avon
Development Code, Title 7 of the Avon Municipal Code. �wN qV

held, and public comment considered, at the Planning & Zoning Commission (PZC) and
Town Council meetings listed below.
DESCRIPTION OF APPLICATION:
Preliminary PUD Amendment — Proposal to amend the PUD Guide for following changes to
Planning Area F, a 12 -acre property located at the intersection of Post Blvd and East Beaver
Creek Boulevard: 1) increase density allowance from 18 dwelling unit/ acre to 25 dwelling units
per acre; 2) increase maximum allowable residential development from 50% to 100; and 3)
increase allowable building height from 48' to 66' for multi -family buildings.
Maximum residential density and commercial square footage of entire Village (at Avon) PUD
would remain the same.

Applicant: Berglund Architects, Stephanie Lord -Johnson
Summary: Application to amend the Buck Creek PUD for greater flexibility for future
development on Filing 3 Lots 2A, 2B, 3, and 5 to allow parking to be shared between
Lot 2A and Lot 3 and to allow the same uses on Lot 2A and Lot 3 (schools, employee
housing units, residential housing units, pedestrian paths and trails, Public assembly
facilities, and Museums and public education facilities).

Action: Commissioner Barnes motioned to approve the application with the following
findings and conditions:
Findings:
1. The Application meets the eligibility requirements for a Minor PUD Amendment by
not increasing density, increasing the amount of nonresidential land use, or
significantly altering any approved building scale and mass of the development.
2. The PUD Amendment does not change the character of the development and
maintains the intent and integrity of the Riverfront PUD.
3. The Application complies with the Avon Comprehensive Plan goals and policies as
outlined in staff's report dated January 2, 2o18.
Conditions:
4. The Application is in conformance with §7.16.o6o(e)(4), Review Criteria, AMC, and
compared to the underlying zoning, the Minor PUD Amendment is not likely to result
in significant adverse impacts upon the natural environment.
1. Any units designated as Employee Residential Units will be permanently deed
restricted to Eagle County employees by form approved by Town of Avon.
z. The cumulative maximum density for lots 2A, 3, and 5 shall be not more than 31
dwelling units.

V. Preliminary PUD (Major Amendment) Village at Avon PUD — CONTINUED PUBLIC HEARING

Summary: PUD Guide amendment for changes to Planning Area F, a 13 -acre property located at
the intersection of Post Blvd and East Beaver Creek Boulevard, including: i) increase
density allowance from i8 dwelling unit/ acre to 25 dwelling units per acre; z) increase
maximum allowable residential development from 50% to loo; and 3) increase
allowable building height from 48' to 66' for multi -family buildings. The applicant
requested that the public hearing be continued to the February 20, 2017 PZC

Public Comments: Chris Ekrem spoke in general opposition to the application.
Action: Commissioner Nusbaum motioned to continue the public hearing until the February
20, 2017 meeting. Commissioner Golembiewski seconded the motion and the motion
carried unanimously 5-0.

Proposal to rezone the parcel to the Mixed -Use Commercial and Open Space,
Landscaping, and Drainage zone districts. The includes a 185 room hotel / 25 unit
condominium development, with restaurant and supporting retail uses, with a height
Of 95 feet. The PUD Overlay would allow for reduced parking supply, increased
building height, and development within 40% slopes.
Public Comments:
Matt Abramowitz commented about potential additional public benefits for the PZC
to consider.
Action:
Commissioner Howell motioned to approve file REZ1800l with the following findings:
i.
The Application was reviewed in accordance §7.i6.05o, Rezonings, Avon
Development Code, and is found to be in substantial compliance with the review
criteria and Avon Comprehensive Plan, as outlined in the staff report;
z.
The Application is substantially compliant with the purpose statements of the
Development Code by providing for the orderly, efficient use of the Property, while
at the same time conserving the value of the investments of owners of property in
Town; and

MC and OLD districts are found to be compatible with adjacent residential
development based upon the intent to integrate mixed-use buildings that transition
from residential to commercial development found in the Town Core.
Commissioner Glaner seconded the motion and it carried 5-0.
Commissioner Howell motioned to approve file PUD1800l with the following Findings
and Conditions:
Findings:
1. The property and project are eligible for PUD approval based on the eligibility
requirements in Section 7.16.060 (b), Eligibility Criteria.
i. The Application is substantially compliant with the purpose statements of the
Development Code by providing for the orderly, efficient use of the Property, while
at the same time conserving the value of the investments of owners of property in
Town;
3. The Application demonstrates compliance with the goals and policies of the Avon
Comprehensive Plan;
4. Compared to underlying MC zoning, the PUD overlay exceptions would not result in
significant adverse impacts upon other properties; and
5. The tangible public benefits presented with the PUD application are commensurate
with the increase in building height, reduction in parking, and limited development
on 40% slopes.
Conditions:
t. A complete Final PUD must be submitted within six (6) months of Town Council
action;
z. The application will include the following submittal requirements:
a. Landscape Plan prepared by a Licensed Landscape Architect. Irrigation and water
budgeting based on best management practices and environmentally
responsible/reasonable use shall be incorporated into the PUD guide at the
requirement of the Upper Eagle Regional Water Authority (UERWA).
b. Preliminary Subdivision, as specified by Section 7.16.o6o(e), Procedures, shall be
submitted concurrently with Final PUD.
C. Comprehensive Plan Amendment will be submitted for Mixed -Use designation on
Future Land Use Map.
d. Water Rights obtained by UERWA.
e. Development Agreement.
3. The PUD Guide will be amended, Page 25 -Building Height, in order for the "L" portion
of the structure to match the building height of the plans as presented.
Commissioner Glaner seconded the motion and it carried 3-2, with Commissioner
Barnes and Golembiewski voting in opposition.

Summary:
Staff presented the master planning document Town of Avon Town -Owned Properties
Plan which proposes various uses and buildings for properties throughout town. The
Commission was tasked to make a recommendation on the plan to the Avon Town
Council, who takes final action with an Ordinance.
Public Comments:
Tamera Underwood spoke in favor of the Barn relocation. Christy Ferraro spoke in
favor of the Barn relocation. Andrew Pranger spoke in favor of including the Vail
Valley Art Guild in any final design of Tract G.
Action:
Commissioner Golembiewski motioned to approve the application recommendation
with the following findings:
1. Integrating additional worker housing units into future development of the Wildridge
Fire House, Swift Gulch, Public Works Site can be made compatible with existing and
future planned land uses by careful design;
2. The relocation of the Hahnewald Barn helps to preserve the historical importance of
Avon's history and identity;
3. Transportation services and infrastructure can serve the proposed future land uses
contained in the Plan;
4. Public services and facilities have adequate current capacity to serve the proposed
future land uses;
5. The proposed land use in the Plan will result in a better location and form of
development for the Town, with critical mass focused in the Town Center and less
intensive land uses on outlying Town -Owned properties;
6. Strict adherence to the current Comprehensive Plan documents would result in a
situation that contrasts with the current direction of the Town;
7. The Plan complies with the purposes of the Development code; in particular, the Plan
provides a deliberate and orderly use of lands, conserving the value of the
investments of the people of the Avon Community;
8. Compliance with the mandatory review criteria outlined in Section 7.16.03o(c) are
documented herein; and
9. The Plan will promote the health, safety and welfare of the Avon Community and will
be consistent with the general goals and policies of the Avon Comprehensive Plan as
outlined in the Staff report to PZC.
Commissioner Glaner seconded the motion and it carried unanimously 5-0.
Action: Commissioner Howell motioned to recommend to Town Council to prioritize the
Hahnewald Barn understanding that the timeline to move it is quickly coming.
Commissioner Glaner seconded the motion and the motion carried 3-2 with
Commissioner Golembiewski and Nusbaum voting in dissent.
VII. Meeting Minutes

Action: Commissioner Nusbaum motioned to approve the meeting minutes. Commissioner
Howell seconded the motion and it carried unanimously 4-0 with Commissioner
Hardy abstaining.

Town Council PZC work session on February 27.
