Regular Meeting
The regular meeting of the Town of Avon Planning and Zoning Commission was called
to order by Chairperson Jack Hunn at 7:35 p.m., March 19, 1996, in the Council
Chambers, Avon Municipal Building, 400 Benchmark Road, Avon, Colorado. All
members were present except Buz Reynolds, Jr.

George Harrison asked to move item I, Lot 3, Nottingham Station; Avon Crossing from
the work session agenda to "Other Business" on the regular meeting agenda.

A. Approval of the March 5, 1996 Meeting Minutes

Commissioner Schneiderman made a motion to approve the consent agenda and it was
seconded by Commissioner Vest.
Commissioner Stanley stated that she wanted to have a conversation added to the
minutes. She stated that Mr. Larry Doll stated that the duplexes would be built the same
as they were now as far as he knew and then later stated the foundation would need to be
torn out because it was not in the right place, the units they built were not selling, and
they might come back with a different design for the area.
Commissioner Schneiderman amended her motion to Table the consent agenda, the
seconded concurred and the motion carried unanimously.
Final Design Review
A. Lot 85, Block 1, Wildridge Subdivision
Project Type: Residential, four-plex
Owner: Cary Builders
Applicant: Eric Johnson, Architect
Street Address: 2436 Draw Spur
Commissioner Railton made a motion to table the final design for the residential four-
plex on Lot 85, Block 1, Wildridge subdivision. Seconded by Commissioner
Schneiderman and the motion carried unanimously.
B. Lot 31, Block 1, Benchmark at Beaver Creek; Centennial Veterinarian
Project Type: 2 variance applications to 1) construct a kennel structure
within the 10 foot rear setback, 2) construct a concrete retaining wall
within the 7.5 foot side yard setback.

Motion - Variance #1

Commissioner Schneiderman made a motion to grant Variance 41 for Lot 31, Block 1,
Benchmark at Beaver Creek subdivision with the following findings in the Zoning Code
17.36.050:
A. (That the granting of the variance will not constitute a grant of special
privilege inconsistent with the limitations on other properties classified in
the same district.)
2. B. (That the granting of the variance will not be detrimental to the public
health, safety, or welfare, or materially injurious to properties or
improvements in the vicinity.)
3. C2 (There are exceptional or extraordinary circumstances or conditions
applicable to the site of the variance that do not apply generally to other
properties in the same zone.)
Seconded by Commissioner Railton and the motion carried unanimously.
Motion - Variance #2
Commissioner Railton made a motion to grant Variance 92 for Lot 31, Block 1,
Benchmark at Beaver Creek subdivision with the following findings in the Zoning Code
17.36.050:

Seconded by Commissioner Stanley and the motion carried unanimously.
Motion - Design Modification
Commissioner Railton made a motion to recommend in concept to Council to approve
off-site grading on the rear of Lot 31, Block 1, Benchmark at Beaver Creek subdivision.

Seconded by Commissioner Stanley and the motion carried unanimously.
Other Business
The following items were discussed:
Color samples for Lot 3, Nottingham Station; Avon Crossing.
Commission's concerns about the color of the Swift Gulch facility.
Norwest underground parking lot.
Chairperson Hunn referenced Lot 23, Block 1, Wildridge as an example where an
applicant states that it was his home, he would live there, water the trees by hand, didn't
need an automatic irrigation system, etc... and he had spent more money replacing trees
than he would have irrigating.
Nwspaper boxes being on someone's private property (Oscar Tang) without their
knowledge.
Status was of getting the traffic lights synchronized.
The dumpster at T.J. Connor's.
If the residents at Eaglebend III were using their garages for parking or just the parking
lots
Adjournment
Commissioner Schneiderman made a motion to adjourn the meeting. It was seconded by
Commissioner Stanley and the meeting adjourned at 9:20 p.m.
