A RESOLUTION RECOMMENDING TO THE TOWN
COUNCIL OF THE TOWN OF AVON APPROVAL OF AN
AMENDMENT TO SECTIONS 17.24.020 6. AND 17.20.020 8
OF THE AVON MUNICIPAL CODE TO ALLOW
PROJECTS WITH RESERVED PARKING SPACES TO BE
ELIGIBLE FOR PARKING REDUCTIONS AND TO
CLARIFY THAT SPECIAL REVIEW USES ARE ELIGIBLE
FOR PARKING REDUCTIONS, TOWN OF AVON, EAGLE
COUNTY, COLORADO
WHEREAS, ATS Joint Ventures by J. T. Berga of WDC Inc. has applied to amend
Sections 17.24.020 6 and 17.20.020 8 of the Municipal Code to allow projects
with reserved parking spaces to be eligible for parking reductions and to clarify that
special review uses are eligible for parking reductions:
WHEREAS, after notices required by law, a public hearing was held by the
Planning & Zoning Commission of the Town of Avon, at which time the
applicant and the public were given an opportunity to express their opinions and present
certain information and reports regarding the proposed code amendments, and
WHEREAS, pursuant to Section 17.28.070 E. and 17.28.080. of the Avon
Municipal Code, the Planning & Zoning Commission has considered the
following criteria:
1. Need for proposed amendment.
2. Present and future impacts on the existing adjacent zone districts, uses, and physical
character of the surrounding area.
3. Availability of utilities for any potential development.
4. Present and future impacts on public facilities and services, including but not limited
to fire, police, water, sanitation, roadways, parks, schools, and transit.
5. The relationship between the proposal and the town comprehensive plan.
6. Public benefits arising from the proposal.

Rezoning Criteria
1. Is the proposed rezoning justified by changed or changing conditions in the character
of the area proposed to be rezoned?
2. Is the proposed rezoning consistent with the town's comprehensive plan?
3. Is the proposed use(s) compatible with the surrounding area or uses?
4. Are adequate facilities available to serve development for the type and scope
suggested by the proposed zone?
NOW, THEREFORE, BE IT RESOLVED, THAT the Planning & Zoning
Commission hereby recommends to the Town Council of the Town of Avon, Eagle
County, Colorado to approve the Amendment to the Avon Municipal Code, Sections
17.24.020 6.and 17.20.020 8 to allow projects with reserved parking spaces to be eligible
for parking reductions and to clarify that special review uses are eligible for parking
reductions based upon the following findings:
1. There is a need for the proposed amendment.
2. There would be not detrimental impacts on existing and adjacent zone districts, uses,
and physical character of the area; these would be assessed with individual
applications.
The amendment is consistent with the Town's Comprehensive Plan.
4. There would be public benefits from the amendment.
5. The amendment is compatible with the surrounding uses and neighborhood.
