Introduction
This application is for a modification to the final design to place a hot tub between buildings C
and D at Canyon Run. The hot tub would be located adjacent to the stairwell on a landing
between these buildings. The hot tub is recessed with a concrete walk around the edge. There
are two rock retaining walls less than four feet tall above the hot tub.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
• Allowed use: The hot tub is accessory to the allowed residential use.
• Setbacks: The hot tub is set flush with and below the grade and is therefore not subject to
setbacks and the building envelopes established for the PUD. There is language in the
PUD , Note 8, amended PUD, that "The building envelope is defined such that roof
overhangs, exterior decks (including on -grade patios) are to be contained within the
envelope. Exterior on -grade walks and access stairs are not constrained by the building
envelopes. The hot tub is outside the building envelope. Staff is interpreting the PUD
Note 8 to state that decks associated with, and attached to the building must fall within the
envelope. The deck adjacent to the hot tub is not subject to the building envelopes
because it is not associated with the building and is part of the exterior walk -way system.
• Easements: No proposed encroachments.
• Grading: Approval of the plan will be subject to staff approval that the proposed grading
for this amendment is not in conflict with the overall revised grading plan for the site.

2. The suitability of the improvement, including type and quality of materials of which it is to be
constructed and the site upon which it is to be located.
The hot tub is an accessory use to the condo buildings. The hot tub is recessed to be
surrounded by rock retaining walls. The deck and retaining wall should blend in to the
surrounding landscaping.
3. The compatibility of the design to minimize site impacts to adjacent properties.
There will not be any significant impact of this design on adjacent properties. The hot tubs
will introduce activity on the site in proximity to the river, but it is not anticipated to create a
negative impact to persons enjoying the river or the soft path that will run through the
property.
4. The compatibility of the proposed improvements with site topography.
The hot tub will require the use of rock retaining walls to maintain a 2:1 slope. There will not
be a significant change to the site's topography.
5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring
properties and public ways.
The hot tub will be visible only from the river. It will not have a negative impact on river
users as the site is already being developed for urban uses.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity that values,
monetary or aesthetic will be impaired.

7. The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
The hot tub and retaining wall modification is not in conflict with any adopted Goals, Policies
and Programs for the Town of Avon.
Staff Recommendation
Approve with conditions.
Recommended Motion
Approve the design modification for Lot 4, Nottingham Station Subdivision, as described on the
Canyon Run - Hot Tub Plan, dated 6-18-96 (sheets 1, 2 and 3) with the following conditions:
1. The proposed retaining walls above the hot tub shall not exceed 48 inches (four feet) in
height.
2. The plan conform to the amended PUD, Exhibit A.
3. Final grading plan and design of rock retaining walls to be approved by staff.
