The applicant wants to remove dirt from the undeveloped portion of the property. The applicant
states the dirt was deposited in its current position during construction of the existing Townhouse
building in 1986. The site will be returned to natural grade and revegetated.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
The proposed excavation and subsequent restoration of the site to its natural grade and
revegetation conforms with the Zoning Code and other applicable Town regulations.
2. The suitability of the improvement, including type and quality of materials of which it is to be
constructed and the site upon which it is to be located.
N/A.
3. The compatibility of the design to minimize site impacts to adjacent properties.
During excavation, standard erosion control measures and clear delineation of the property
boundaries will need to be utilized minimize any potential impacts to adjacent properties.
Additionally, once the excavation is complete, re-vegation measures will need to be
maintained to further insure minimal potential site impacts to adjacent properties.
4. The compatibility of the proposed improvements with site topography.
The restoration of this portion of the lot to its natural grade and re -vegetation would appear
to be compatible with the site topography.

5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring
properties and public ways.
The restoration of this portion of the site should not negatively affect its visual appearance as
viewed from adjacent and neighboring properties and public ways.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity that values,
monetary or aesthetic will be impaired.

7. The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
Based upon the proposed excavations apparent conformance with the above Design Review
Considerations, the excavation will conforms with the adopted Goals, Policies and Programs
of the Town of Avon.
Staff Recommendation
Staff recommends approval of the excavation as depicted on the topographic survey sheet
stamped "Received" July 2, 1996 subject to the following conditions:
1. That temporary erosion control measures be installed, per Town of Avon standards, prior to
the start of the excavation.
2. That the temporary erosion control measures be maintained until revegetation measures have
significantly taken hold.
