Introduction
The applicant is requesting approval to store fill dirt on this site in anticipation of its future
development. The fill will be coming from the applicant's project currently underway on the
opposite side of Wildridge Road. The applicant is proposing to place temporary erosion control
measures below the fill to prevent excessive erosion. Additionally, the applicant will provide a
cash surety to restore the site to its original state if construction is not started within nine months.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
The proposed placement of fill on this site in anticipation of the sites' development conforms
with the Zoning Code and other applicable regulations of the Town.
2. The suitability of the improvement, including type and quality of materials of which it is to be
constructed and the site upon which it is to be located.
The proposed placement of fill on the site will include measures to prevent temporary
erosion. Additionally, the applicant will provide surety for the site's restoration in the event
the anticipated development is not undertaken within nine months. It would also be advisable
to include in the agreement that specific measures be taken to control dust. Acceptable
measures would include hydro -seeding, jute covering, or a combination of seeding and jute
covering. With the combination of these measures, this propose should be suitable for the
site.
3. The compatibility of the design to minimize site impacts to adjacent properties.
Site impacts to adjacent properties should be partially minimized by the already mentioned
proposal for temporary erosion control. The addition of stabilization measures to prevent the
spread of dust, and a clear physical delineation of the southern property line would further
insure minimizing any impacts to adjacent properties.

4. The compatibility of the proposed improvements with site topography.
Development of this site will most likely require the importation of fill. The applicant intends
to begin developing this lot by next spring. The ability to place the excess fill from the
current project on Lot 23 onto Lot 66 will greatly help facilitate the completion of both
projects.
5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring
properties and public ways.
The placement of fill on this lot will not provide an aesthetically pleasing appearance in the
interim period before completion of any construction. However, the applicant is proposing
this as a preliminary step towards the site's eventual development and thus can be viewed as
being similar to normal construction activity. The provision of a cash surety will strongly
encourage the applicant to secure a building permit and begin construction in a reasonable
time period.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity that
values, monetary or aesthetic will be impaired.

Programs for the Town of Avon.
This proposal appears to generally conform with the adopted Goals, Policies and Programs
for the Town of Avon.
Staff Recommendation
Staff recommends approval for the placement of fill on this site as proposed with the additional
conditions that stabilization measures be used, the southern property line be clearly delineated
and a limit of nine months by imposed upon any approval.
Recommended Motion
Approve the placement of fill dirt on Lot 66, Block 3, Wildridge Subdivision as presented on the
plans dated, August 16, 1996, and proposed by the applicant's letter to the Building Department,
Town of Avon, dated, August 16, 1996, with the following conditions:
1. That surety in the form of a cash bond or cash deposit equal to 150% of the estimated amount
necessary to restore the site to its original condition be provided before any work is started.
2. That one of the following stabilization measures: hydro -seeding; jute covering; or a
combination of seeding and jute covering, be used to prevent dust.
3. That the southern property line be physically delineated by construction limits fencing to
prevent any depositing of fill onto the neighboring property.
4. That the approval lapse in nine months if a building permit for the site has not been secured
by this applicant.
