Aimee Sochrin is requesting to connect two existing second floor decks and enlarge the area of
the decks at Lot 84, Block 1, Wildridge. The modification is requested for the end unit on the
west side of the Wintergreen Townhomes building. Lot 84 has been subdivided into four
townhome lots and a fifth lot, Lot 5, which is the common area for the association. The deck is
proposed on Lot 1, and also is proposed to encroach into Lot 5 (common area) by an area
approximately six feet by eighteen feet.
The deck will match the material and color of the existing deck. The deck is located adjacent to
a sewer line easement and is proposed to cantilever over the easement. The applicant has
received conditional approval for the deck from Upper Eagle Valley Sanitation.
She is also requesting approval of a split rail fence adjacent to her driveway and sidewalk. The
split rail fence is proposed to be a 5 foot tall split rail cedar fence. Two five foot sections of
fence are proposed. The fence does not encroach into the commons area.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
• Lot Coverage: The building will continue to conform to the 50% maximum building
coverage.
Setbacks: The deck and fence do not encroach in any setbacks. The zoning setbacks
apply to the perimeter of Lot 84, and not the individual townhome lot lines.
Easements: The deck would cantilever up to 3 feet 6 inches over the sewer line easement.
Upper Eagle Valley Sanitation District has approved the deck provided certain conditions
are met. A copy of their letter with conditions is included. The commons area is also
reserved as a blanket utility easement. There are no known utilities underneath the

proposed deck. The second story deck would not deter access to any utilities that could
be located underneath the deck. The applicant will be responsible for obtaining utility
locates prior to construction of the deck.
• Grading: No change in grading is required for the deck.
• Landscaping: The deck will not significantly change the amount of landscape area. There
is an existing tree on the north side of the deck that will remain.
2. The suitability of the improvement, including type and quality of materials of which it is to be
constructed and the site upon which it is to be located.
The deck expansion will match the colors and materials and design of the existing deck. The
fence will be a natural stained cedar. These materials match existing materials and are
therefore suitable for the site.
3. The compatibility of the design to minimize site impacts to adjacent properties.
The deck is proposed on an end unit. It will only be visible to the adjacent unit to the east.
The deck extension will be to the west and will not significantly change the view from the
adjacent unit. The deck should not be visible from any other units in the immediate vicinity.
4. The compatibility of the proposed improvements with site topography.
This second story deck will not require any changes to the site grading and is compatible
with the lot's topography.
5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring
properties and public ways.
The expanded deck will not significantly change the appearance of the unit or the complex.
The deck expansion is proposed on the north and west side of the unit. Other than the
condominium to the east, there are no other homes or units in the area that the deck will be
very visible to.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity that
values, monetary or aesthetic will be impaired.
Not applicable.
7. The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
The proposed deck and fence are not in conflict with any adopted Goals, Policies and
Programs. Although fencing is generally discouraged by the design guidelines, only two
very short sections of fencing are proposed. These will not impact wildlife or change the
character of the property.
Staff Recommendation
Approve with conditions.
Recommended Motion
Approve Lot 84, Block 1, Wildridge Subdivision, modification of deck, as shown on site plan
dated August 6, 1996 with the following conditions:
1. That the deck conforms to the conditions required by Upper Eagle Valley Sanitation District.

2. That a grant of easement or written approval from the Wintergreen Home Owner's
Association for the deck encroachment into the common area (as depicted on the revised site
plan application) shall be provided before building permit application.
3. The site plan be revised to show the property boundaries of the Townhome and common area
lots.
4. The deck materials and paint will match the existing decks.
5. The tree on the north side of the unit will remain.
6. The applicant will be responsible for obtaining utility locates prior to construction of the deck
and fence and obtain any required approval from the utility companies.
