Dawn Melendez has applied for a Special Review Use for a childcare home in an existing half -
duplex at 680 West Beaver Creek Boulevard, Lot 6B, Block 2, Benchmark at Beaver Creek
Subdivision. Day care is provided primarily Monday through Thursday from 8:00 AM to 5:30
PM. The childcare home may occasionally take children outside of these hours.
This use is defined as a home occupation and may be approved as a special review use.
Criteria for Review
According to section 17.48.040 of the Avon Municipal Code, the Planning & Zoning
Commission shall consider the following criteria when evaluating an application for a special
review use permit:
Whether the proposed use otherwise complies with all requirements imposed by the zoning
code.
The childcare home is proposed in an existing duplex. The duplex conforms to all of the
standard zoning requirements including parking, landscaping and setbacks. The daycare use
would conform to all requirements of the Zoning Code.
2. Whether the proposed use is in conformance with the town comprehensive plan.
Policy D1.6 of the Comprehensive Plan encourages the development of neighborhood and
community based day care facilities.
3. Whether the proposed use is compatible with adjacent uses.
In staff's opinion, the childcare home will be compatible with the surrounding residential
area and Nottingham Park. The home has a small number of children. A parking and drop
off area is available in front of the home. The home has a fenced deck as well as a back yard
adjacent to Nottingham Park for outside play. Staff believes the home is well suited for a
small day care.

Staff Recommendation
Staff recommends approval of the Helping Hands Child Care Home, as described in the
application materials dated February 17, 1999.
Recommended Motion
Approve Resolution # 99-9, granting a Special Review Use Permit for the Helping Hands Child
Care Home as described in the application and materials dated February 17, 1999, Lot 6B, Block
2, Benchmark at Beaver Creek Subdivision.
