The Town of Avon Planning and Zoning Commission regularly meets at 6:00 p.m. on the first
and third Tuesday of each month, in the Avon Council Chambers, Avon Municipal Building, 400
Benchmark Road, Avon, CO 81620. Meeting agendas are posted at least 72 hours in advance of
the meeting in the following locations:

Motion: Commissioner Fehlner moved to approved items A, B, C, and the additional item D

Agenda. Commissioner Karow seconded. Motion passed unanimously with Commissioner
Fehlner abstaining from item A, as she was not present at the May 4, 1999, meeting.

Motion: Commissioner Fehlner moved to approve Resolution #99-12 amending the Special
Review Use Permit for Lot 45, Block 1, Benchmark at Beaver Creek Subdivision to allow a
second accessory apartment within the church parsonage as described in the plans dated May 3,
1999 based upon the following findings.
1. That the proposed use is in conformance with the Town Comprehensive Plan.
2. The proposed use; is compatible with adjacent uses.
3. The proposed use otherwise complies with all requirements
Commissioner Morrison seconded. The motion passed unanimously.
VII. Final Design Review
A. Lot 47, Block 1, Benchmark at Beaver Creek Subdivision —
Nightstar Residences
Project Type: Multi -family Apartment Building

Motion: Commissioner Macik moved to deny the Final Design for the residential apartment
project for Lot 47, Block 1, Benchmark at Beaver Creek Subdivision as depicted on the
application and plan set dated May 26, 1999, based upon the findings that the project fails to
satisfy design review considerations #6 and #7. Commissioner Sipes seconded. Motion passed
4 —2 with Commissioner Morrison and Commissioner Fehlner opposing.
B. Lot 21, Block 1, Wildridge Subdivision - Jaap/McVey

Motion: Commissioner Karow moved to deny the proposed duplex design for Lot 21, Block 1,
Wildridge Subdivision as depicted on the application and plan set dated April 5, 1999, and May
14, 1999, based on the finding that it does no conform the Review Considerations #6 and #7 as
discussed in the staff report to the Planning and Zoning Commission dated May 26, 1999.
Commissioner Macik seconded. The motion passed 4-2 with Commissioner Morrison and
Commissioner Fehlner opposing.
C. Lot 26, Block 2, Wildridge Subdivision — Roth Duplex
Project Type: Residential Duplex Design Modifications
Property Owner / Applicant: Mike Roth
Address: 2605 Beartrap Road
Motion: Commissioner Sipes moved to approved the proposed design modification proposed
on the documents dated May 4, 1999, item 6G, addition of a window on the rear elevation.
Commission Morrison seconded. Motion passed unanimously.
D. Lot 11, Block 1, Benchmark at Beaver Creek Subdivision —
Avon Auto Body
Project Type: Modification to Final Design for Industrial Building
Property Owner: Patricia and Louis Mederios
Consultant: Roger Landing, JMP Architects
Address: 451 Metcalf Road
Motion: Commissioner Fehlner moved to approve the modification of building materials and
not the screening for Lot 11, Block 1, Wildridge Subdivision as depicted on the application and
plan set dated May 17, 1999, with the following conditions:
1. That the eastern screen wall shall be denied based upon the materials submitted.
2. The materials of the retaining wall on the west side of the site shall be stucco or split face
block and match the building colors.
3. Final drainage and grading to be approved by staff in conjunction with the building permit
review.
4. All conditions from the approval dated April 15, 1997 still apply, with the exception of
number 1. which required a berm for screening.

E. Lot 103, Block 1, Wildridge Subdivision — Ste — Marie
Duplex
Project Type: Residential Duplex
Property Owner: Richard Ste - Marie
Applicant: Bob Mach
Address: 3023 Wildridge Road
Motion: Commissioner Sipes moved to approve the final design of a residential duplex for lot
103, Block 1, Wildridge Subdivision as depicted on the application and plan set dated May 11,
1999, with the following conditions:
1. That the site plan be revised to move the retaining wall entirely out of the 10 fool Slope
Maintenance, Drainage and Snow Storage Easement.
2. That the site plan be revised to eliminate disturbance of the neighboring property to the west.
3. That the site plan be revised to move the western surface parking area and associated
retaining wall out of the 7.5 foot drainage easement.
4. That an additional Improvement Location Certificate (ILC) will be required prior to any
framing inspections to confirm all ridge heights comply with the; maximum allow height.
5. That the Town the is not responsible for any damage to plant materials in the Town's 10 foot
Slope Maintenance, Drainage and Snow Storage Easement resulting from municipal snow
removal operations.
6. That all mislabeled ridge elevations on the site plan be corrected.
7. That all potted landscape materials meet the Town's minimum 5 -gallon size requirement.
8. Landscape plans be resubmitted for staffs approval
9. The light fixture specified all though will except the 150 -watt light bulb but will not add more
than a 40 -watt light bulb installed.
Commissioner Fehlner seconded. The motion passed unanimously.
F. Lot 51, Block 2, Wildridge Subdivision
Project Type: Residential Duplex

Address: 2626 Beartrap
Motion: Commissioner Karow moved to table the final design of a residential duplex for Lot
51, Block 2, Wildridge Subdivision with direction to the applicant to revise the plans to provide
complete and accurate project depiction. Commissioner Sipes seconded. The motion passed
unanimously.
G. Lot 8, Block 5, Wildridge Subdivision — Wildwood West
Townhomes
Project Type: Residential Multi -family

Motion: Commissioner Karow moved to approve the final design of the two tri-plexes for Lot
8, Block 5, Wildridge Subdivision as depicted on the application and plan set dated May 12,
1999, with the following conditions:
1. That an additional Improvement Location Certificate (ILC) will be required prior to any
framing inspections to confirm all ridge heights comply with the maximum allowable height.
2. That the berm above the entrance be reduced to no more that two fee above the driveway
elevation to provide better sight distance.
3. That the proposed post -mounted exterior light fixtures are not approved due to the concern
that they will produce unnecessary glare.
5. That the two aspens near the first structure's guest parking be moved south to provide better
site distance.
Commissioner Macik seconded. The motion passed unanimously.

Adjourn
Commissioner Sipes moved to adjourn the meeting at 9:30 P.M. Commissioner Karow
seconded. The motion passed unanimously.
