Introduction
The applicant is requesting approval for a Development Sign variance advertising the newly
approved Chapel Square development. The Town of Avon Sign Code states in part that
development signs shall not exceed 16 square feet in area and 18 feet in height. It further states
that development signs not meeting the specified criteria may be approved by the Planning &
Zoning Commission upon the determination that a variance should be granted pursuant to section
15.28.090 B of the Avon Municipal Code.
The proposed development sign is 32 square feet in area and up to 8 feet in height. It will be
located near the existing Wal-Mart entry sign in front of the row of mature coniferous trees.
Design Review Considerations
The staff reviewed the variance request with respect to the following criteria:
1. The relationship of the requested variance to other existing or potential uses and
structures in the vicinity.
The location of the sign against the existing trees should provide an effective and attractive
background.
2. The degree to which relief from a strict or literal interpretation and enforcement of a
specified regulation is necessary to achieve compatibility and uniformity of treatment
among sites in the vicinity, or to attain the objectives of this title without grant of special
privilege.
Due to the large mixed-use nature of the devilment, the applicants feel the larger sign area is
needed to effectively communicate all the necessary information.
3. Such other factors and criteria applicable to the proposed variance.

The site for this development is located well behind the sign's proposed location. The
applicants feel the larger sign with graphics and text is needed for the sign's vehicular
orientation.
Findings Required
According to section 15.28.090.B.3 of the Avon Municipal Code, the Planning & Zoning
Commission shall make the following findings before granting a variance:
A. That the granting of the variance will not constitute a grant of special privilege
inconsistent with the limitations on other properties in the vicinity;
B. That the variance is warranted for one or more of the following reasons:
1. The strict, literal interpretation and enforcement of the specified regulation would
result in practical difficulty or unnecessary physical hardship inconsistent with the
objectives of this title;
2. There are exceptional or extraordinary circumstances or conditions applicable to the
site of the variance that do not apply generally to other properties in the same zone;
3. The strict or literal interpretation and enforcement of the specified regulation deprive
the applicant of privileges enjoyed by the owners of other properties in the same
district.
Staff Recommendation
Staff recommends approval of the proposed Development Sign variance as submitted on the
application dated February 25, 1997.
Recommended Motion
Approve the Development Sign variance for Chapel Square as presented on the application dated
February 25, 1997 based upon the following findings:
A. That the granting of the variance will not constitute a grant of special privilege inconsistent
with the limitations on other properties in the vicinity;
B. That the variance is warranted for one or more of the following reasons:
1. The strict, literal interpretation and enforcement of the specified regulation would result in
practical difficulty or unnecessary physical hardship inconsistent with the objectives of this
title;
