The applicant, Walter Klaus, is requesting a special use permit to operate an auto repair facility in Unit
102 of the Metcalf Commercial Center, located in the IC (Industrial and Commercial) zone district. Unit
102 contains 1,309 square feet Gross Floor Area (GFA).
The closest applicable definition in the Avon Municipal Code is "Automobile service station and repair."
[17.08.080] However, this definition specifically excludes "heavy automobile maintenance activities,"
such as those Mr. Klaus would perform.
Mr. Klaus works almost exclusively on German cars, and states in his application that he usually has no
more than three cars on site at a time, and these would be parked inside the shop. Mr. Klaus also stated
that he will not store or repair cars outside of the shop. Based on this, it seems reasonable that the
character and level of activity conforms more to the definition of "Service Station."
The parking requirement for a Service Station is two (2) spaces per 1000 square feet GFA. Based on this,
the proposed use requires of four (4) spaces.
The Metcalf Center is approved as a warehouse use, which requires 1 parking space per 850 square feet
GFA. Overall, the project is 9 spaces in excess of the town parking requirements. The property owner is
allocating those extra spaces to uses, on a case-by-case basis, to uses that are permitted by zoning, and
require parking in excess of 1 space per 850 square feet.
• As a warehouse or similar use, Unit 102 would require two (2) spaces.
Criteria for Review, Recommendation and Approval
According to section 17.48.040 of the Avon Municipal Code, the Planning & Zoning
Commission shall consider the following criteria when evaluating an application for a special
review use permit:
1. Whether the proposed use otherwise complies with all requirements imposed by the zoning
code.
2. Whether the proposed use is in conformance with the town comprehensive plan.

3. Whether the proposed use is compatible with adjacent uses. Such compatibility may be
expressed in appearance, architectural scale and features, site design, and odor, lighting,
traffic, safety, etc.
Staff Recommendation
Because of the limited scope of the proposed use, the lack of need for outside parking or storage
of automobiles, and relatively exclusive nature of the clientele, the proposed use would likely not
be incompatible with adjacent warehouse and other similar uses.
Staff recommends granting of the special use permit for an automobile repair shop, with no
outside repair or storage of cars, and including provision of four (4) parking spaces.
Recommended Motion
Approve Resolution # 96-13 granting a special review use permit for Lot 18/19, Block 1,
Benchmark at Beaver Creek Subdivision for an auto repair facility, as described in the
application dated September 24, 1996.
