Introduction
This application was tabled at the May 19, 1998 Planning and Zoning Commission meeting. The
application for a lower level addition and deck has been modified to include a roof over the
proposed deck. The applicant is proposing that all of the railings be metal and painted to match
the color of the building. The window and door modifications have not changed from the
application presented at the May 19, 1998 meeting.
The applicant has determined the height of the roof from the eave line to the existing grade is 32
and '/z feet. It is his position that the ridgeline is not over height based on this measurement and
the slope of the land to the point under the roof.
The attached maps show the original building design on page 1, the modification approved by
the Town in 1992 on page 2, the modification requested at the May 19th meeting on page 3 and
the revised application on page 4.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning
Code.
According to Section 17.32.030 of the Zoning Code, a non -conforming structure shall not be enlarged
upon in such a way as to increase the non -conformity but any structure may be enlarged or altered in such
a way as to decrease the non -conformity. In staff's opinion the revised application decreases the potential
non -conformity. It adds a new roofline, which breaks up the length of the southern wall and gives the
building a stepped appearance. The addition also would not increase the actual height of the building.
Since this is the case, staff does not feel it is necessary to verify whether the building height exceeds the
35 -foot height limit. It is staff's opinion that the addition is not in conflict with the Zoning Code.
2. The conformance with other applicable rules and regulations of the Town of Avon.
3. The type and quality of materials of which the structure is to be constructed.
The roof design complements the main roof. If the metal railing is painted to match the existing structure,
staff feels it will blend in with the existing building and be compatible with the building design.
4. The design of site grading and drainage to minimize impacts to adjacent sites, rights-of-way
and easements.

The natural grade will be restored after construction; therefore the addition is compatible with the existing
site topography.
5. The compatibility of proposed improvements with site topography, to minimize site
disturbance, orient with slope, step building with slope, and minimize benching or other
significant alteration of existing topography.

6. The appearance of proposed improvements as viewed from adjacent and neighboring
properties and public ways, with respect to architectural style, massing, height, orientation to
street, quality of materials, and colors.
The addition of the roofed deck should serve to break up the length of the south wall and give the building
more of a stepped appearance more in keeping with other buildings in the neighborhood.
7. The objective that no improvement be so similar or dissimilar to others in the vicinity that
monetary or aesthetic values will be impaired.

8. The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
Staff Comments
Staff believes the modified application addresses concerns presented in the May 19th Planning
and Zoning Commission report and is now in conformance with the Design Criteria and Zoning
Code. We recommend approval of the modification.
Staff Recommendation
Staff recommends approval with conditions.
Recommended Motion
"I move to approve the proposed lower story addition, deck addition and railing modifications
for Lot 56, Block 2, Wildridge Subdivision as depicted on the plan set dated 5-29-1998, with the
following conditions":
1. The grade shall be restored to the existing grade after construction.
2. Metal railings, decking, roof material, window frames and trim shall match existing colors
and materials of the structure.
