Introduction
Chapel Square LLC. has applied for two temporary signs to be posted on the C and B buildings
and indicate that Chapel Square is "now leasing". Each sign would be 120 square feet, with a
total of 240 square feet.
The Sign Code permits a development sign up to 16 square feet. The applicants already have a
development sign located on their frontage on Beaver Creek Place. Temporary signs are allowed
up to thirty-five square feet and can be displayed for one week for any one event.
The proposed signs are a "hybrid" between the development sign and temporary signs. They are
significantly larger than the signs allowed.
Design Review Considerations
According to the Town of Avon's Sign Code, Section 15.28.070 Design Review Criteria, the
Planning & Zoning Commission shall consider the following items in reviewing proposed
designs:
1. The suitability of the improvement, including materials with which the sign is to be
constructed and the site upon it is to be located.
Not applicable.
2. The nature of adjacent and neighboring improvements.
The property to the west is commercial and the property to the south is residential. The
sign is much larger than surrounding signage and uses bright colors to draw attention.
3. The quality of the materials to be utilized in any proposed improvement.
The material is described by the applicants as heavy-duty plastic. The materials as well
as bright colors are not a high quality material appropriate for a relatively long duration (no
time limit was specified in the application).

4. The visual impact of any proposed improvement, as viewed from any adjacent or
neighboring property.
The signs are proposed on the third story of Building B and the second story of Building
C and oriented toward I-70. In staff's opinion, the size of the sign, the quality of the
materials and bright colors will have a negative visual impact on the character of the area.
5. The objective that no improvement will be so similar or dissimilar to other signs in the
vicinity that values, monetary or aesthetic, will be impaired.
The signs are dissimilar to other signage in the area and would impair aesthetic values.
6. Whether the type, height, size, and/or quality of signs generally complies with the sign
code, and are appropriate for the project.
The second and third story locations of the signs and the 120 square foot size
significantly exceed the sign code limits.
7. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether
the sign is appropriate for the determined orientation
The signs appear to be primarily oriented to I-70 traffic.
Variance Criteria
Before acting on a variance, the Planning and Zoning Commission shall consider the following:
1. The relationship of the requested variance to existing and potential uses and structures
in the vicinity;
The requested variance is to allow a large sign for leasing property at Chapel Square. No other
property owners in the area are given this opportunity for leasing their property.
2. The degree to which relief from the strict or literal interpretation and enforcement of a
specified regulation is necessary to achieve compatibility and uniformity of treatment
among sites in the vicinity;
The variance is not needed to achieve uniformity of treatment. All other area signage must
conform to the sign code. The applicants have already been granted a variance for their existing
development sign, to exceed the maximum square footage.
3. Such other factors and criteria as the Commission deems applicable to the requested
variance.
Staff has not identified any other factors.
Findings required to approve a variance:
4. The strict or literal interpretation and enforcement of the regulation would result in
practical difficulty or unnecessary physical hardship inconsistent with the objectives of
this title;
In staff's opinion there will not be a practical difficulty or unnecessary physical hardship that is
unique to this property.
5. There are exceptional or extraordinary circumstances or conditions applicable to the
site of the variance that do not apply generally to other properties in the vicinity
In staff's opinion there are no extraordinary circumstances or conditions applicable to this
property.

6. The strict or literal interpretation and enforcement of the specified regulation would
deprive the applicant of privileges enjoyed by the owners of other properties in the
vicinity.
The enforcement of the current sign regulations would not deprive the owners of privileges
enjoyed by other property owners.
Staff Recommendation
Staff recommends that the application be denied, based on the signs are not in confonnance with
sign design review criteria 1-7.The size of the signs significantly exceed sign code standards, the
materials and colors are not compatible with surrounding development, the signs are so
dissimilar they will have a negative aesthetic impact and the signs are oriented to interstate
highway traffic. The signs do not conform to the criteria required for approving a variance.
Recommended motion
I move to deny the sign application for temporary leasing signs for Chapel Square Buildings B
and C, located on Lots 22 and 22A, Chapel Square Subdivision, as described in the application
dated 10-26-98, based on the signs are not in conformance with sign design review criteria 1-7,
as enumerated in Section 15.28.070 of the Avon Municipal Code, including that the size of the
signs significantly exceed sign code standards, the materials and colors are not compatible with
surrounding development, the signs are so dissimilar they will have a negative aesthetic impact
and the signs are oriented to interstate highway traffic. The signs do not conform to the criteria
required for approving a variance.
