Introduction
The applicant is requesting the approval of a split rail fence to create a safety barrier between the
adjoining properties. On September 12, 2001 the Planning and Zoning Commission approved a
day care at this property and this fence application is a direct result of neighborhood requests to
the applicant to fence her property if a day care is operated.
The fence proposed is a three -tier split rail fence with chicken wire to prevent infants or toddlers
from leaving the premises.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the
Zoning Code.
• Allowed use: Conforms with the allowed residential use.
• Lot Coverage: The split rail fence is proposed for the backyard area running along a
drainage easement on one side. It does not delineate the property boundaries.
0 Setbacks: The split rail fence does not interfere with the setbacks.
• Building Height: Not applicable
• Landscaping: No additional landscaping is being proposed.
2. The type and quality of materials of which the structure is to be constructed.
The split rail fence is consistent with the Town's requirements for fencing materials.
3. The appearance of proposed improvements as viewed from adjacent and neighboring
properties and public ways with respect to architectural style, massing, height,
orientation to street, quality of materials and colors.
The split rail fence is designed to create a barrier for toddlers and infants at the day care.
The project should blend in with the site and is not extremely noticeable when viewed
from neighboring properties.

4. The objective that no improvement be so similar or dissimilar to others in the vicinity
that monetary or aesthetic values will be impaired.
The fence is similar to other fences in the area.
5. The general conformance of the proposed improvements with the adopted Goals,
Policies and Programs for the Town of Avon.
The fence is in conformance with the goals, policies and programs of the Town.
Staff Recommendation
Staff recommends approval of the fence application for Lot 41, Block 1, Wildridge Subdivision
with the following condition:
1. The fence may only be constructed if the approved home occupation of a day care is
finally approved.

On September 18, 2001 the applicant OZ Architecture submitted modifications to approved
plans to the Planning & Zoning Commission ( "the Commission "). The modifications included
the following:
1. Revised details on the entry truss;
2. Changes to the retail arcade, including the column dimensions and arches;
3. Employee housing — modification to the arch materials.
On September 18, the Commission denied the application for modifications. The applicant has
revised the application to include more details and clarification on the changes.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the
Zoning Code.
All of the proposed modifications comply with the zoning code and design standards for
the Town of Avon.
2. The conformance with other applicable rules and regulations of the Town of Avon.
All of the proposed modifications comply with the rules and regulations.
3. The type and quality of materials of which the structure is to be constructed.
The Commission has expressed concern because the proposed materials are not
consistent with what was approved at mock -up and on the Final Design Review plans
with regard to the retail arcade and arches on the employee housing building. The design
review plans indicated 10 "x10" columns and glue -lam arches for the retail arcade. The
applicant is proposing 6 "x6" columns and framed arches in the retail arcade.

The employee housing did not indicate the material for the arches; except at the mock -up
all of the arches were indicated as glue -lam rather than framed arches. The proposed
materials are consistent with other projects approved within Town Center and do not
violate any design standards.
3. The design of site grading and drainage to minimize impacts to adjacent sites, rights -of-
way and easements.
Criteria not applicable.
4. The compatibility of proposed improvements with site topography, to minimize site
disturbance, orient with slope, step building with slope and minimize benching or other
significant alteration of existing topography.
Criteria not applicable.
5. The appearance of proposed improvements as viewed from adjacent and neighboring
properties and public ways with respect to architectural style, massing, height,
orientation to street, quality of materials and colors.
All of the modifications as viewed from adjacent properties and public ways appear
appropriate with massing, height, color and orientation to the street.
Entry truss: The truss facing Beaver Creek Blvd. is different from the truss directly in
back of it. However, it does not appear out of context with adjacent properties or with
the building itself. The applicant has proposed as an alternative to make the trusses
consistent. Staff recommends approval of the existing truss.
Retail arcade: The 6 "x 6" columns and the framed arches on the retail arcade have an
appropriate mass and architectural style. The Commission has expressed concern
because the proposed materials are not consistent with what was approved at mock -up
and on the final design review plans. The materials, massing and architectural style are
appropriate.
Employee housing: The massing of the arches and the architectural style are appropriate
for the building.
7. The objective that no improvement be so similar or dissimilar to others in the vicinity
that monetary or aesthetic values will be impaired.
The modifications are not so similar or dissimilar to others commercial projects within
the Town that monetary or aesthetic values will be impaired.
8. The general conformance of the proposed improvements with the adopted Goals,
Policies and Programs for the Town of Avon.
Overall, the modifications proposed by the Applicant comply with the adopted goals and
policies for the Town.
Staff Recommendation
Staff recommends approval of all of the modifications to the approved plans for Lot C,
Sheraton Mountain Vista.
