The applicant, George Plavec, is proposing a duplex residence located at 5010 Wildridge Road.
The project is a lodge -style duplex with wood and stucco trim. Each unit is approximately 2,600
square feet, and both sides include an attached 2 car garage.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning
Code.
• Allowed use: Conforms with the allowed residential use.
• Density: Duplex.
• Lot Coverage: Conforms with lot coverage
• Setbacks: The proposed residence extends closely to one setback and leaves no room for
error. The applicant will be required to verify the setbacks prior to commencing
construction by a licensed surveyor.
• Easements: There are no encroachments in the 10' Drainage and Utility Easement.
• Building Height: The height restriction for the lot is 35'0" and the proposed height is in
compliance with the height restrictions. The applicant will be required to verify
elevations at foundation and framing stages by a licensed surveyor.
• Grading: Clarify the elevations on the ditch to provide for adequate drainage. The
grading for window well and adequate egress on the east elevation requires clarification.
• Parking: The applicant is providing sufficient parking on site.
• Snow Storage: Submitted plans comply with the Town requirements for snow storage.
Snow storage is adjacent to the proposed impermeable surface area.
• Landscaping: The landscaping plan is sufficient All disturbed areas will be restored with
native grasses and flowers with a minimum of 2" of topsoil.

Introduction
This minor project is being submitted by the owner of the Vista Brasserie, Gary Borris, to
construct a windbreak shelter attached to the outside of the restaurant, on the west side of a small
patio seating area. The windbreak proposed will be constructed of plexi -glass and wood
framing, and stands approximately nine feet high and fifteen feet long. The windbreak will be
stabilized by concrete support posts installed 3'- 4' into the ground and metal supports at grade.
Currently, several concrete bollards connected by a chain delineate the small patio area.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning
Code.
• Allowed use: Conforms with the allowed commercial use.
• Density: Not Applicable.
• Lot Coverage: Not Applicable.
• Setbacks: Not Applicable.

2. Permits for allowed temporary structures may be issued by the Director of Community
Development without review by the Commission. Permits shall run concurrent with building
permit.
B. Fences and Signs
1. Fences, walls, or similar type barriers shall have separate approval of the Commission, except
that functional or decorative fences or walls may be approved as an integral part of a building
design. Wood fences are generally more acceptable than metal. Limited use of fences is
encouraged;
2. No signs, billboards, or other advertising of any kind shall be erected constructed, or maintained
on any lot or structure unless approved in accordance with the provisions contained in the Sign
Code of the Town of Avon.
C. Communications & Satellite Dish Antennae
1. All antennas shall be located so as to be screened from view from any public right -of -way or
neighboring property. Screening may be accomplished by, or through the use of landscaping
materials, fencing, existing structures subgrade placements or other means that both screen the
antennas and appear natural to the site;
2. All wiring and cable related to antennas installation shall be installed underground or be
incorporated entirely within the structure;
3. Color selection for dish antennas should be made with respect to the characteristics of the site or
structure. Unpainted surfaces and dish antennas with reflective surfaces shall not be allowed.
No advertising, logos or identification shall be allowed on any dish antenna.
D. Above Ground Tanks and Miscellaneous Structures
1. Oil, gasoline or liquid petroleum gas tanks will not normally be permitted on or above ground.
Temporary installations for a period not exceeding 2 years may be approved provided the
installation complies with all applicable regulations and is fully screened from view from all
public rights -of -way and neighboring properties;
2. No outdoor clotheslines, trash receptacles, or storage areas will be permitted unless screened;
3. Screening details shall be reviewed and approved by the Commission prior to installation.
4.25 Building Design
A. General Design Characteristics
1. Conforms with setback, building area ratios, and height limitations of applicable zone district;
2. Building oriented to take advantage of solar gain and views;
3. Building design and location minimizes impacts on solar and view corridors of neighboring
properties;
4. Mirror image duplexes are not permitted.
B. Large Commercial Projects
5. Use of pedestrian circulation through the inclusion of Malls, Atriums, and covered walkways is
encouraged;
6. Building design should provide for the convenient delivery of goods and services.

The applicant is requesting the approval of a split rail fence to delineate the property line
between Lots 21 and 22. The two properties share a common driveway as indicate on the
attached site plan. The split rail fence will terminate prior to reaching the designated open space
and Forest Service property.
The owner of Lot 21 has contacted Staff to express concerns with the proposed fence.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning
Code.
• Allowed use: Conforms with the allowed residential use.
• Lot Coverage: The fence will delineate the two properties. There is no other purpose for
the fence it does not enclose a limited area or have a real ending or beginning.
• Setbacks: The split rail fence delineates the property line.
• Building Height: the applicant's request is consistent with the Division of Wildlife
recommendations that fences should not exceed 48" in height. The lower half of the
fence should have an opening of at least 16" to allow for free movement of wildlife.
• Landscaping: The fence is proposed in an area of lawn and natural grasses.
2. The type and quality of materials of which the structure is to be constructed.
The split rail fence is consistent with the Town's requirements for fencing materials.
3. The appearance of proposed improvements as viewed from adjacent and neighboring
properties and public ways, with respect to architectural style, massing, height, orientation to
street, quality of materials, and colors.
The split rail fence is designed to delineate the property boundary but it does not enclose
an area or have a real beginning or ending. If the fence is designed to keep dogs within
the property boundaries, then the fence should enclose a small area and be designed to fit

in with the landscaping and integral to the single family residence. The proposed fence
does not attain any other goal than to delineate the property boundary.
4. The objective that no improvement be so similar or dissimilar to others in the vicinity that
monetary or aesthetic values will be impaired.
There are not any split rail fences in the neighborhood which delineate the property lines
up to the Forest Service property. Generally, fences are designed to enclose an area not
be isolated boundaries between properties.
The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
Staff Recommendation
Staff recommends denial of the fence application. The applicant may revise the application to
enclose a small area for the dogs, which integrates with the home and landscaping.
Recommended Motion
I move to deny the fence application for Lot 22, Block 2, Wildridge Subdivision.

The applicant is requesting the approval of two fences to delineate his property. One fence is a
standard split rail fence and the other fence is a short wood slat fence to screen the rear patio
area. Attached, please find a site plan which indicates the existing fences on the property as well
as the proposed fence. In addition, we have attached an area site plan which indicates all of the
existing split rail fences in the immediate vicinity of the applicant.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 4.10, the Commission
shall consider the following items in reviewing the design of this project:
1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning
Code.
• Allowed use: Conforms with the allowed residential use.
• Lot Coverage: The fence will enclose much of the applicant's property. The fence also
duplicates some of the existing fencing already on the property.
• Setbacks: The split rail fence proposed on both the north and the east side delineates the
property line. The fence on the north (rear patio) has an existing split rail fence where the
applicant is requesting a privacy fence.
• Building Height: The applicant's request is consistent with the Division of Wildlife
recommendations that fences should not exceed 48" in height. Privacy fences are not
prohibited by the Division of Wildlife; they recommend they not exceed 2,500 sq. ft. and
be located close to the residence.
• Landscaping: The fences will be visible from surrounding properties and increase the
amount of split rail fences which have no real beginning or ending. There are fences
which delineate more than three properties in the immediate vicinity and are very visible.
2. The type and quality of materials of which the structure is to be constructed.
The split rail fence and wood slat privacy fence are consistent with the Town's
requirements for fencing materials.
