RESOLUTION NO. 02 -14
SERIES OF 2002
A RESOLUTION ADOPTING THE 2002 UPDATED ZONING MAP
WHEREAS, Section 17.16.030 and 17.28. 100 require that any changes to the zoning of
property by ordinance within the Town of Avon be entered on the Zoning Map; and
WHEREAS, notice was properly posted for the zoning map update and the Planning and
Zoning Commission reviewed the proposed map update at a regular Planning and Zoning
Commission meeting
NOW, THEREFORE, BE IT RESOLVED, that the Planning and Zoning Commission
hereby adopts the year 2002 updated Zoning Map for the Town of Avon as set forth in
Exhibit "A ", attached hereto and incorporated herein by this reference, and further
recommends that the Town Council of the Town of Avon adopt the updated Zoning Map
as the official Zoning Map for the Town of Avon as set forth in 17.16.030 of the
Municipal Code.

1. Review fees charged by a state or federal agency shall be made payable to the reviewing agency based
on current rates and paid at the time of application.
2. For Final Plats, the applicant will be responsible for paying any plat check fees that are in excess of 25%
of the Final Plat application fees. This additional fee must be paid prior to the recording of the Final
Plat.
3. A filing fee is required for the recording of the Final Plat. This is made payable to the Eagle County
Clerk & Recorder, and is based on current recording rates for the plat and for any other documents to be
recorded.
4_ For all applications requiring legal descriptions to be published in the newspaper, additional fees will be
charged on a per cost basis, for publications which are in excess of $50.00.
5. When a Special Use Permit application accompanies a Sketch Plan or Zone District submittal, the
Special Use application fee shall be required unless waived by the Board of County Commissioners.
Application fees shall be paid by cash or by a check made payable to the Eagle County Treasurer, and shall be
submitted with the application to the Community Development Department. Recording fees for the Final flat are to
be paid prior to the recording of the Final Plat, by submitting a check made payable to the Eagle County Clerk &
Recorder. Recording Fees are as follows:

Town a deposit in the suns of three hundred and fifty dollars (5350.00),
plus an additional amount per acre or per unit whichever is greater, as
calculated according to the following schedule. Provided, however, an
initial deposit in excess of three thousand five hundred dollars
(53,500.00) shall not be required.

subdivision, condorninitunization, annexation or preannexation concept
plan, or equivalent, or Planned Unit Development or Development

If a plate, plats or other documents submitted by the developer under the
provisions of this Section are incomplete or are modified so as to require
additional checking and review, or the Town's review expenses have
exceeded the initial deposit, the developer shall pay to the Town an
additional deposit equal in amount to the initial deposit before further
action is taken on the subdivision, condominiurnization, anneXatioti or
preannexation request, or Planned Unit Development application or
Developmenr Pen-nit application.

Prior to passage of the annexation, condominiumization or subdivision
ordinance, or ratification of the preannexation agreement, or approval of
a Planned Unit Development, by the Board of Trustees, Elie developer
shall pay to the Town the actual cost to the Town for engineering,
surveying, consultant planning sorvices provided under the direction of
the Town by any person not a regular frill -time employee of the Tovni,
and legal services rendered in connection with the review of the
subdivision plans, planned unit development or development permit
application plans, plats, and supporting documents, plus the cost of
making corrections or additions to the official Town map, and the fee for
recording the final plat with the County Clerk. Any amount by which the
developer's deposit exceeds the costs assessable under this Section shall
be refunded to the developer after final action has been taken by the
Board of Trustccs, or upon withdrawal of the subdivision, annexation,

preannexation proposal, or planned unit development application or
development hermit application by the developer.
3. The fees for review for Subdivision as found in 4.03.080.C.i.a and
4.03.080.C',1.b shall apply to all subdivisions except requests for Lot
Line Adjustment which requests shall pay a review fee of SISO.

AnplicahilitY
Prior to approval and acceptance of the construction and installation of
public improvements in a subdivision, the subdivider or developer shall
pay to the Town the actual cost of all inspections of such improvements,
including but not limited to, streets, curbs, butters, sidewalks, sanitary
sewer system, storm drainage system, water distribution system, street
signs, and street lighting facilities, made or conducted at the direction of
the Town Administrator or Town Engineer. In addition, the subdivider
or developer shall pay to the Town the actual cost of incorporating the
as- builts into the official town snapping system.
2. Public Improvements Inspection Dcposit
Prior to the beginning of constriction and installation of any public
improveatent in a subdivision or development, unless otherwise provided
in the subdivision improvements ageemeat or development permit,
subdivider or developer shall submit to the Town a deposit in the sum of
Three Hundred Fifty Dollars (5350.00), plus an additional amount per
acre, as calculated in accordance with the following schedule:
L1. first five acres, or any fraction thereof (0 -5.0), S75.00 per acre;
b. Next five acres, or any fraction thereof (5.0 +- 10.0), $50.00 per
acre;
C. Next ten acres, or any fraction thereof (10.0 + - 20.0), $25.00 per
acre;
d. For each additional acre or any fraction thereof in excess of 20.0
acres, S10-00 per acre.
No additional deposit in excess of Three 11housand Five I lundred Dollars
($3,500.00), shall be required. The required deposit shall be tendered to
the Town Clerk. If the Town's public improvements inspection expenses
have exceeded the initial deposit, the subdivider or developer shall pay to
the''own an additional deposit equal in amount to the initial deposit no
liter than thirty (30) days after receiving notice from the Town of said
requircment. Any remaining deposit following deduction of actual costs
for inspections shall be refunded to the subdivider or developer.
