02-16-2015 1st Amendment 2015 Winter Wonder Grass AgreementA Avon COLORADO AMENDMENT TO THE 2015 WINTER WONDER GRASS AND TOWN OF AVON AGREEMENT THIS AMENDMENT ( "Amendment ") to the 2015 WINTER WONDER GRASS FESTIVAL AGREEMENT, originally dated February 15, 2015 ( "Agreement "), is made and entered into the 17th day of February, 2015, by and between the Town of Avon ( "AVON "), a home rule municipality of the State of Colorado, with its principal offices at One Lake Street, Avon, Colorado, 8162o and WONDERGRASS, LLC, hereinafter referred to as the WINTERWONDERGRASS ("WWG"), a Colorado Limited Liability Company with its principal offices at 411 Eagle Drive, Avon, Colorado, 81620. AMENDMENT Pursuant to Paragraph 15 of the Agreement, AVON and WWG agree to amend the Agreement as set forth herein. All other terns of the Agreement shall remain in full force and effect, including but not limited to provisions concerning insurance and indemnification. 1. Upon request by WWG, AVON hereby grants a permit pursuant to Avon Municipal Code Section 9.40.040 to WWG for the use of drone operated video photography within the boundary as shown by the red perimeter ( "Drone Perimeter") on the attached map in accordance with the following terms and conditions: a. This Amendment shall constitute a permit for drone operated video photography associated with the WWG event. b. WWG shall use one DJI Phantom Vision drone which is approximately 1.5 feet wide by 1.5 feet long and 1 foot high and propeller length of 9" and diagonal of 13.8" c. This permit for drone operated video photography shall only permit such use on Friday, February 20 through Sunday, February 22, 2015, from 5:00 p.m. 7:00 p.m. in the Drone Perimeter. d. WWG represents and warrants that the drone operated video photography can and will be operated in safe and responsible manner and will not create a clear and present danger to the public. e. WWG agrees to exercise diligent caution to restrict any drone operated video photography to times when such drone equipment can be operated safely and responsibly. f. The Town Manager or designee may restrict drone operations at any time do to weather conditions, potential conflicts with other activities, or for other public health, safety and welfare concerns in the sole judgment of the Town.
